BILL NUMBER:S5775
Title of bill
An act to amend the correction law, in relation to requiring level two sex offenders to register their employment address and relating to certain requirements of distribution of the subdirectory
Purpose or general idea of bill
The bill will require all level two sex offenders in New York State to register the address of their employment and to update certain sections of law with current practice.
Summary of specific provisions
Section one amends paragraph (a) of the subdivision 1 of section 168-b of the correction law to mandate that level two sex offenders (along with level three) provide a place of actual or expected place of employment.
Section two amends paragraph (b-1) of subdivision 2 of section 168-f of the correction law to verify whether or not a level two sex offenders address of employment remains the same or has changed since such employment was last reported.
Section three amends subdivision 1 of section 168-·q to eliminate the requirement that a subdirectory of level two and three sex offenders be distributed to local law enforcement agencies and updated monthly.
Section four is the effective date.
Justification
To increase the usefulness of the sex offender registry, this bill will require the registration of the address of employment for level two sex offenders.
When SORA was first enacted, the subdirectory of level two and three sex offenders was printed and distributed to law enforcement agencies by the division of criminal justice services. Given the number of offenders listed on the subdirectory, it soon became impossible to create a printed subdirectory. Several years ago, the division of criminal justice services discontinued print access and directed law enforcement agencies to allow the public to view the subdirectory through the DCJS website. However, the outdated language directing the annual distribution and monthly updating remains in the law and should be removed to reflect current practice.
