BILL NUMBER:S5828
Title of bill
An act to amend the environmental conservation law, in relation to reviewing the west of Hudson River New York city drinking water supply system program
Purpose
This legislation will require the Commissioners of the Department of Environmental Conservation and New York City Department of Environmental Protection with water management experts from federal agencies, to review the West of Hudson River New York city drinking water supply program and make recommendations as to strategies that could potentially alleviate the threat of flooding to flood plain residents
Summary of provisions
Section One - amends the environmental conservation law is amended by adding a new section 15-0809 15-0809 of the Environmental Conservation Law relating to studies and recommendations to alleviate the threat of flooding in certain areas of the State. The Commissioners of the Department of Environmental Conservation and New York City Department of Environmental Protection, in consultation with water management experts from federal agencies, would be required to review the West of Hudson River New York city drinking water supply program and make recommendations as to strategies that could potentially alleviate the threat of flooding to flood plain residents while at the same time continuing to satisfy the requirements of the U.S. Supreme Court decree in New Jersey v. New York, 347 U.S. 995 (1954) and ensuring an adequate supply of high quality drinking water to the municipalities who rely on such system. The bill also requires a hydrological study of the Esopus Creek to identify areas at chronic risk of flooding as well as measures that could potentially reduce flood damage to flood plain residents.
Section Two - this act shall take effect immediately.
Justification
In April 2005, massive floods swept through many counties within New York State. The flooding caused major damage to many communities, including the destruction of many homes and roadways, numerous injuries and at least one fatality. This flood was one of the worst floods the region has seen in over 50 years.
The study required by this bill will help identify methods to mitigate the potential for future flooding, including, but not limited to, the monitoring and maintenance of reservoir levels during high flow events and the extension and/or expansion of rain-based and snow pack spill control programs.
