BILL NUMBER:S5886 REVISED 09/16/11

Title of bill

An act to amend the environmental conservation law, in relation to enacting the New York state comprehensive flood mitigation grant act; making an appropriation therefor and providing for the repeal of such provisions upon expiration thereof

Purpose

To create a comprehensive state-wide mitigation grant program run by the Department of Environmental Conservation.

Summary of provisions

The Commissioner of the Department of Environmental Conservation shall establish a flood mitigation program which municipalities can apply to establish flood mitigation programs. The Commissioner will establish application rules and procedures and the department will work with each municipality to coordinate approved programs. $5 million dollars will be appropriated to the DEC out of monies in the general fund for the first year; $10 million dollars will be appropriated in the second year. For the third year and all years thereafter no more than $15 million dollars will be appropriated for this program. This bill will sunset on December 31, 2019.

Justification

Major flooding problems continually affect New York municipalities in coastal locations, and along rivers, streams and brooks. Correction or mitigation of these flooding problems often involve significant new capital projects that are extremely expensive to develop, build and/or operate, proving to be a huge burden on local property taxpayers. This state mitigation fund would provide direct capital assistance to reduce the costs of these projects, insuring their implementation and the resulting reduction in future flood damages.
