BILL NUMBER:S5888
Title of bill
An act to amend the executive law, in relation to requiring the state to pay local municipalities' share of the costs not covered by municipal public assistance from the federal government
Purpose
To require that the State shall pay any non-Federal share for municipal damage for which the Federal government has paid 75% of as a result of Hurricane Irene and Tropical Storm Lee.
Summary of provisions
Amends the Executive Law to require that the State pay the remaining portion of any Federally aided municipal damage from Hurricane Irene or Tropical Storm Lee where the President has issued a disaster declaration for the impacted municipality.
Effects of present law which this bill would alter
Often, localities, through their taxpayers, pay 12.5% of the cost of disaster recovery for municipal damage. This legislation would ensure that the State pay those costs.
Justification
Hurricane Irene and Tropical Storm Lee caused substantial damage across New York State. Asking municipalities to pay a portion of the repair costs, when those municipalities can do nothing but pass the expense onto already struggling property taxpayers is inappropriate in these very challenging economic times and given the massive damage done in many municipalities.
Legislative history
New legislation.
Fiscal implications
To be determined after the Federal government determines what municipal damages are eligible for assistance.
Effective date
Immediately.
