BILL NUMBER:S5912
Title of bill
An act to enact the "flood assessment relief act of 2011"
Purpose or general idea of bill
This bill would offer property tax assessment relief to those property owners who were impacted by the flooding that resulted from tropical storms Irene and Lee.
Summary of specific provisions
Section one establishes the bill as the "flood assessment relief act of 2011".
Section two of the bill outlines the counties who would be covered and defines the specific terms used in the legislation.
Section three provides for a local option for the counties.
Section four allows for municipalities to reassess property that has been damaged by a flood in specific counties.
Section five allows school district to be held harmless.
Section six is the effective date.
Justification
This legislation allows localities the option to participate in the flood assessment relief act of 2011 and therefore make adjustments to the 2011 real property tax rolls. After the wide spread flooding that occurred as the result of Tropical Storms Irene and Lee many counties in the State were designated as both Federal and State disaster areas. Thousands of New Yorkers sustained severe damage to their properties, resulting in a dramatic drop in their values. This legislation would give municipalities the option of taxing residents on the value of their homes after the floods.
Prior legislative history
Similar legislation was adopted in 2007 and 2005.
Fiscal implications
None to the State.
Effective date
This act shall take effect immediately.
