BILL NUMBER:S6023A

Title of bill

An act to amend the executive law, in relation to participation by independent living centers in minority and women owned business requirements

Purpose of general idea of bill

The purpose of this bill is to abate an "unintended consequence" of the existing statute for minority and women owned businesses by removing from the definition of state contract those services provided by Independent Living Centers in New York State.

Summary of specific provisions

Section 1. Subdivision 13 of section 310 of the executive law, as amended by chapter 506 of the laws of 2009, redefines the definition of "state contract."

Justification

Independent Living services are labor intensive in nature, and, in accordance with Federal standards based on a "peer relationship." The proposed level of required participation to meet the target of the Education Department requires many centers to layoff qualified individuals with disabilities (whose employment rate is five to seven times the state average) to provide contracting opportunities as required by the statute, in essence harming one disenfranchised population to assist another.
