BILL NUMBER:S6049

Title of bill

An act to establish a blue ribbon commission on competition in the outdoor recreation industry; and providing for the repeal of such provisions upon expiration thereof

Purpose

To establish a commission to examine issues surrounding the public ownership of outdoor recreational facilities and make recommendations regarding methods to promote competition in the outdoor recreation industry.

Justification

The outdoor recreation industry, including businesses which operate golf, skiing and camping facilities, is an important segment of the economy in New York State and it is crucial to the continued success of this industry that all of the owners of outdoor recreation facilities are competing on a level playing field. The public ownership of such facilities raises competitive issues which should be examined to ensure competition in the outdoor recreation industry.

Public owners of outdoor recreation facilities enjoy tax advantages, possible reduced equipment and borrowing costs, as well as other potential advantages. These advantages may allow such facilities to charge reduced fees, thereby making them more attractive to the public and potentially making it more difficult for private owners of outdoor recreational facilities to compete. This bill would establish a blue ribbon commission on competition in the outdoor recreation industry to examine and evaluate the extent of these advantages and their impact on competition and make recommendations regarding methods to promote competition in the outdoor recreation industry.

The commission shall make a report to the governor and the legislature of its findings, conclusions and recommendations on or before one year following the enactment of this proposal.
