BILL NUMBER:S6121
Title of bill
An act to amend chapter 594 of the laws of 2011, relating to authorizing the establishment of a long term care community in Columbia county known as Camphill Ghent, Inc. to provide integrated services to certain persons, in relation to statutory authorizations; and to repeal section 4 of such chapter relating thereto
Purpose
The purpose of this bill is to modify provisions of Chapter 594 of 2011 to allow residents of the adult home and assisted living program at Camphill Ghent to age in place.
Summary of provisions
This bill would provide necessary statutory exemptions that allows Camphill Ghent residents to "age in place" in a fully integrated setting, subject to the approval of the Commissioner of Health and the Public Health and Health Planning Council, provided that there would be no rate adjustments or supplemental payments to offset costs of additional services arising from such exemptions.
Justification
Camphill Ghent is a continuous care facility for senior citizens located in Columbia County that serves individuals with developmental disabilities along with other individuals in an integrated setting. In an effort to address the needs for the aging population at Camphill Ghent, the Legislature passed Chapter 594 of the Laws of 2011 that permits residents to remain at Camphill Ghent as they age and require more intensive care. This chapter amendment is necessary to clarify that the assisted living program at Camphill Ghent is subject to the approval of the Commissioner of Health and the Public Health and Health Planning Council. Further, this chapter amendment is necessary to eliminate provisions requiring enhanced funding for Camphill Ghent as such funding is not currently accounted for in the State financial plan.
