BILL NUMBER:S6142

Title of bill

An act relating to actions taken by the Smithtown Central School District regarding capital improvements eligible for state aid

Purpose

Relates to validating actions taken by the Smithtown Central School District regarding capital improvements eligible for state aid.

Summary of specific provisions

Section 1 provides for the legislative intent. Section 2 legalizes, validates, ratifies and confirms the Smithtown Central School District's compliance with the requirements set forth so they shall receive the appropriate state aid previously allotted to them for certain capital projects. Section 3 directs the State Education Department to consider the approved costs of the aforementioned projects as valid and proper obligations of the Smithtown Central School District.

Justification

The Smithtown Central School District approved several capital improvement projects which were eligible for certain state aid. Due to an administrative error, required filings for eligibility for such aid were not made by the district in a timely manner making the district ineligible for certain aid, causing hardship on district taxpayers. In 2011, the District learned that because 4 reports were not filed on time, the District could lose $3.1 million dollars in aid for that year.

The Smithtown School District considers the safeguarding of taxpayer funds as one of its paramount responsibilities, and is seeking legislation to rectify this situation.

Fiscal implications

To be determined.
