BILL NUMBER:S6170A

Title of bill

An act to amend the executive law, in relation to a prohibition on diversion of funds dedicated to public transportation systems

Purpose

The bill amends section 182 of the Executive law, to prohibit funds dedicated to public transportation systems from being diverted towards another purpose, unless a statute is enacted to authorize such a diversion.

The bill declares that funds dedicated to public transportation systems may only be diverted by statute, and that the legislation must include a diversion impact statement written by the director of the budget. Such statement must include the amount of the diversion from each transit dedicated fund listed separately, the amount diverted expressed as current monthly transit fares, the cumulative amount of diversion from the previous 5 years and a detailed estimate of the impact of the diversion from dedicated mass transit funds will have on service, maintenance, security and the current capital program. The funds affected are listed as including, but not limited to § 88-a and 89-c of the state finance law and chapter 25 of the Laws of 2009.

Summary of provisions

This bill requires that the funds, which were put into law for the express purpose of funding public transportation systems, be used for their intended purpose or requires that the director of the budget provide a detailed statement on impact of the diversion of funds. By retaining these funds for the system, we stabilize fares and protect funding for the systems operations. In 2011 the Governor signed Chapter 56 which created Section 182 of the Executive Law. The new section prohibits the director of the budget, and others, from using administrative action to divert the funds unless the Governor declares an emergency and to propose a diversion of those funds by statute. This bill prohibits the director of budget from taking administrative action to divert funds.
