BILL NUMBER:S626
Title of bill
An act to amend the penal law, in relation to prostitution crimes
Purpose or general idea of bill
To increase the penalties for promoting prostitution when an Internet website is used and for promoting prostitution or patronizing a prostitute.
Summary of specific provisions
Section 1 amends penal law section 230.30 by adding two new subsections (3) and (4) to read as follows:
A person is guilty of promoting prostitution in the third degree when he knowingly: (3) commits the crime of promoting prostitution in the third degree and the managing, supervising, controlling or owning of the prostitution business or enterprise involving prostitution involves the use of an internet website; or (4) commits the crime of promoting prostitution in the third degree and he or she has been previously convicted of the crime of promoting prostitution in the third degree four or more times.
Section 2 amends penal law section 230.05 by adding new subsection (2)to read as follows:
A person is guilty of patronizing a prostitute in the second degree when, being over eighteen years of age, he or she commits the crime of patronizing a prostitute in the fourth degree or the patronizing a prostitute in the third degree and he or she has been previously convicted of the crime of patronizing a prostitute in the fourth degree or patronizing a prostitute in the third degree, or any combination of such crimes, four or more times.
Justification
There are currently multiple Internet sites that advertise full-service escorts. These escorts are willing to come to New York State and provide their services to whomever is willing to pay. The problem is that the penalties are so low that there is little incentive for those in this business to stop. Ultimately people get arrested over and over again and the problem of prostitution continues.
The police and the courts use their time, energy and money to process the same people over and over again. This legislation will not only increase penalties for those arrested for prostitution, but it will include those individuals who are soliciting prostitution on the Internet and advertising that they will come to New york State.
Further. there is an anomalY in the laW that thOSe JohnS who solicit business in person have lesser ability to reach a large number of clients. while thoSe who solicit businesS in thiS area with the internet can have a "",ch higher patronage rate. conduct more business. and make more money in this activity. This bill heightens the crime for those who solicit on the Internet because this
activity is wider in scope in the volume of business that can secured than soliciting business in person.
