BILL NUMBER:S6309

Title of bill

An act to amend the village law, in relation to requiring five percent of the number of people who voted in the last gubernatorial election to sign a petition

Purpose

Requires petitions for permissive referendums to be signed by 5% of the total village vote cast at the most recent gubernatorial election.

Summary of provisions

Subdivision 1 of section 9-902 of the village law is amended to change the number of required signatures to five per centum of the total village vote cast at the most recent gubernatorial election.

Justification

This bill would make village and town law uniform in permissive referendum petition signature requirements. Current village law requires an extensive amount of signatures not necessary or feasible in a small village, where as town law is more practicable, therefore this bill amends village law to be identical to town law in this instance. The present number of petition signatures required for a village to set forth a permissive referendum is difficult and, in some cases, impossible to obtain. The electorate within a given village should be able to have their voices heard in a fair and equitable manner, as do the towns.
