BILL NUMBER:S6314
Title of bill
An act to amend the public health law, in relation to authorizing the commissioner of health to issue a death certificate to any applicant upon the request of a sibling of the deceased
Purpose
To add siblings to the list of authorized family members who can request a death certificate.
Summary of provisions
Section 1. Paragraph (a) of subdivision 1 of section 4174 of the public health law would be amended to add siblings of deceased persons to the list of family members authorized to obtain a death certificate upon request.
Existing law
Current law only allows a parent, spouse or child of the deceased to obtain a death certificate upon request. This bill would simply add siblings to the list of family members that are authorized to request and be issued a death certificate.
Justification
Often a sibling may be the closest living relative to the deceased. In the case where a decedent's parents may also be deceased and the decedent has no children, a sibling should be authorized to be issued a death certificate upon request.
