BILL NUMBER:S6412

Title of bill

An act to amend the vehicle and traffic law, in relation to the definition of a drivers' school

Purpose

To exclude rider course training sites or instructors/rider coaches from the definition of drivers' school.

Summary of provisions

Section one - amends paragraph (a) of subdivision 1 of section 394 of the vehicle and traffic law to exclude rider course training sites or instructors, approved by section 410-a of this chapter, from the definition of drivers' school.

Section two - provides the effective date.

Justification

The definition of drivers' school in section 394-a of the vehicle and traffic law is intended to govern any person or business entity that provides for-hire instruction in the operation of a motor vehicle or motorcycle. Instruction includes on-road, behind-the-wheel instruction and pre-licensing courses.

The New York State Motorcycle Safety Program (NYSMSP) is defined in section 41 a-a of the vehicle and traffic law. However, due to the limited definition of drivers' school in section 394, NYSMSP training site providers are included in the drivers' school classification. As a result, these providers are subject to drivers' school regulations which are not consistent with the design or purpose of motorcycle safety programs.

The misclassification and subsequent regulations create unnecessary barriers. While there is a statewide demand for motorcycle safety programs, these requirements hinder small businesses from securing qualified instructors/rider coaches and training sites.

Amending the drivers' school definition in section 394 will exempt training providers in the delivery of the NYSMSP course from the drivers' school definition. This clarification will enable the 41 a-a motorcycle safety program to be the stand-alone program, as it was intended, and can be governed by its own specific regulations. This change would have no impact on DMV licensed motorcycle drivers' schools, only rider course training sites approved under the 4] a-a motorcycle safety program.
