BILL NUMBER:S6626

Title of bill

An act to amend the executive law, in relation to the placement of level-two and level-three sex offenders in hotels and motels

Purpose

This bill grants local authority to protect the safety and welfare of residents with regard to the placement of level-two and level-three sex offenders within their own communities.

Summary of provisions

Section one creates a new subdivision 5 of Section 243 of the executive law providing the local governing body of a county, town, or village with the authority to regulate and restrict the placement of multiple level-two or level-three sex offender in the same hotel, motel, or other multiple dwelling by resolution of said governing body.

Section two sets the enacting date.

Justification

Currently, the Director of Sex Offender Management and Treatment has exclusive authority in the placement of level-two and level-three sex offenders. As a result local municipalities have no control over the placement of sex offenders in particular locations, which are otherwise within their own jurisdictions. One major negative consequence of this practice has been the placement of multiple high level sex offenders in a single location.
