BILL NUMBER:S6632
Title of bill
An act to amend the criminal procedure law, in relation to examination of certain witnesses
Purpose or general idea of bill
To expand the grounds for conditional witness examination to include physical incapacitation, mental illness or incapacity, or advanced age.
Summary of specific provisions
Section 1 of the bill amends subdivision 2 of section 660.20 of the criminal procedure law to include physical incapacity, mental illness, and advanced age within the grounds for the order of conditional witness examination.
Section 2 provides for an effective date.
Justification
Often victims of elder abuse are unable to withstand long term judicial proceedings. This bill would strengthen the ability of prosecutors to bring convictions against the perpetrators of crimes against the elderly by allowing conditional witness examination of elderly witnesses who may not be able to handle the stress of facing their accusers in the courtroom setting of a trial.
