BILL NUMBER:S6704

Title of bill

An act to amend the education law, in relation to exempting BOCES capi- tal expenditures from limitations upon local school district tax levies

Purpose

The purpose of this legislation is to exempt expenditures from limita- tions upon local school district tax levies.

Summary of provisions

Section 1. Amends Paragraph c of subdivision 2 of section 2023-a, of the Education law by expanding the definition of "Capital local expendi- tures" by adding "...and the school district's share of such expendi- tures for board of cooperative educational services (BOCES) capital facilities and BOCES capital equipment".

Section 2. Amends Paragraph b of subdivision 4 of section 2023 of the Education Law by adding the following language to the end of the para- graph "...provided however, that capital expenditures and capital improvement projects by the board of cooperative educational services (BOCES) shall not be included in total spending."

Section 3: This act shall take effect immediately with provisions.

Justification

When the property tax cap was passed in 2011, the state excluded school bonding for capital projects. Recently, it has come to our attention that bonding for BOCES capital projects which also comes under local school district budgets was not excluded. This legislation will correct the overnight, and exclude bonding for BOCES capital projects.
