BILL NUMBER:S6813
Title of bill
An act to amend the penal law, in relation to possession of a gravity knife for purposes of criminal possession of a weapon in the fourth degree
Purpose or general idea of bill
To decriminalize possession of a gravity knife in certain circumstances.
Summary of specific provisions
Amends subdivisions (1) and (2) of Penal Law Section 265.01.
Justification
Currently, a person can be convicted of criminal possession of a weapon in the fourth degree under Penal Law Section 265.01(1) if that person possesses any of the weapons specified therein, regardless of intent. Gravity knives are included in this section. Many knives are recognized as having legitimate purposes for a variety of occupations, but gravity knives are not exempted from this section despite the frequency with which they are used legitimately for work purposes. This bill would make possession of a gravity knife a crime only when accompanied by the intent to use it unlawfully against another. By only criminalizing possession of a gravity knife in this manner, workers with legitimate reasons to carry the knife will no longer be subject to prosecution for possessing a tool commonly used in their profession.
