BILL NUMBER:S7024
Title of bill
An act to amend the mental hygiene law, in relation to duties of providers of services for the developmentally disabled
Purpose
To require all group for the developmentally disabled to post a visible notice to all employees that New York State law mandates the reporting of all forms of abuse to local law enforcement and district attorneys. Employees must also be trained with regard to these reporting requirements.
Summary of provisions
Section 31.11 of the Mental Hygiene Law is amended by adding two new subdivisions 6 and 7.
Justification
Many times employees of group homes for the developmentally disabled notice that a client has visible signs of abuse. However, they report it to their supervisor and this information never gets to law enforcement agencies where the perpetrator can be prosecuted. This legislation would require that the abuse be reported to law enforcement and district attorneys. It would also require that employees be trained in what action to take if they notice signs of abuse.
