BILL NUMBER:S7034
Title of bill
An act to amend the retirement and social security law, in relation to military service credit for combat veterans who served in any conflicts after August 2, 1990
Purpose
To provide military service credit for retirement for combat veterans who served in all hostilities and conflicts as determined by the Presi- dent during the time period of "after August 2, 1990 to the present."
Summary of provisions
The opening paragraph and paragraph (d) of subdivision 2 of section 1000 of the retirement and social security law, as added by chapter 548 of the laws of 2000 are amended to add veterans who have served in a combat theatre or combat zone of operations.
Paragraph (d) is amended to include all hostilities and conflicts after the second day of August, nineteen hundred ninety as determined by the president of the United States.
Justification
Currently military service credit is only granted to veterans who served in the "theatre of operations" from August 2, 1990 including Iraq, Kuwait, Saudi Arabia, Bahrain, Qatar, the United Arab Emirates, Oman, the Gulf of Aden, the Gulf of Oman, the Persian Gulf, the Red Sea and airspace above these locations.
The intent of the bill is to allow military service credit to those combat veterans who served in all hostilities and conflicts as deter- mined by the President of the United States during the time period after the second day of August nineteen hundred ninety but did not actually serve in the "Theatre of Operations."
Granting military service credit for retirement to combat veterans serv- ing in all conflicts and hostilities after August 2, 1990 is the least we can do for the brave men and women who have sacrificed so much for our country.
