BILL NUMBER:S7035
Title of bill
An act to amend the public health law, in relation to adding the super- intendent of financial services to the early intervention coordinating council
Purpose
Increases to twenty-seven members the state Early Intervention Coordi- nating Council (EICC) to include the superintendent of financial services to comply with federal guidelines.
Summary of provisions
Section 1 of the bill increases the number of members on the early intervention coordinating council from twenty-six to twenty-seven members and specifies that seven members shall be the commissioners of: health, education, office of children & family services, people with developmental disabilities, mental health, alcoholism and substance abuse services, and the superintendent of financial services, or their designated appointees.
Section 2 provides the effective date for this legislation.
Justification
The federal Individuals with Disabilities Education Act (IDEA) requires member composition for State Interagency Coordinating Councils relating to Early Intervention services meet certain criteria. One requirement is that at least one member represent the agency responsible for the State regulation of private health insurance. Prior to the enactment of the 2011 state budget, that role had been filled by the Superintendent of Insurance, or their designated appointee.
However, the 2011 budget established the Financial Services Law, consol- idating the Department of Banking and Department of Insurance into the Department of Financial Services. As a result, the Superintendent of Insurance's representation on the EICC was removed. In order to meet federal regulations, an appointee from the Department of Financial Services must be represented on the council.
This legislation puts New York within federal compliance, and expands the number of scats by one to ensure that the Department of Financial Services receives representation at the council. These changes were suggested by the State Early Intervention Coordinating Council chair- person.
