BILL NUMBER:S7081
Purpose or general idea of bill
To grant Janice A. Riley a retroactive date of retirement in the New York state and local employees' retirement system.
Summary of specific provisions
This bill would grant a retroactive retirement date for the New York State and Local Retirement System to Janice A. Riley by deeming her to have been granted a retirement status date of November 5, 2006, instead of November 5, 2010.
Justification
This legislation would grant retroactive retirement system status and benefits based on a retirement date of November 5, 2006 to Janice A. Riley who is a member of the NY State and Local Retirement System. Ms. Riley currently has a retirement date of November 5, 2010 due to an error with retirement paperwork being inadvertently mishandled by NY State and Local Retirement System when it was sent in to them when she first filed for retirement.
Ms. Riley was a member of NYS Retirements system from 1975 to 1987 as an employee of Jones Memorial Hospital in Wellsville, New York, where she worked for 35 years.
Jones Memorial Hospital was part of the Village of Wellsville system until January 1, 1988 when it divested from the village. Since Ms. Riley was employed while it was part of the Village, she became eligible for NYS retirement benefits.
Ms. Riley is currently collecting retirement, but a paperwork error has prevented her from collecting benefits starting November 5, 2006, instead, only granting her retirement from November 5, 2010.
Ms. Riley has copies of her original mailed notarized application with retirement date of November 5, 2006 which was mailed on March 15, 2007, qualifying her for the November 5, 2006 date.
Additionally, Jones Memorial Hospital's Human Resources Office staff have sworn under notarized statement that Ms. Riley's paperwork was submitted properly to the NY State and Local Retirement system for a November 5, 2006 retirement date.
It is evident due to documentation of this case that it was inadvertent- ly mishandled at the state agency level, and through no fault of Ms. Riley's she has been denied the proper retirement date of November 5, 2006. This bill seeks to correct that error and distribute to Ms. Riley, retroactively, her entitled benefits.
