BILL NUMBER:S7117

Title of bill

An act to amend the real property tax law, in relation to exempting un-remarried spouses of paid or volunteer fire fighters, ambulance work- ers or policemen who have fallen in the line of duty from all or a portion of their real property taxes on their primary residence

Purpose

This legislation amends the real property tax law to allow local govern- ments to exempt unremarried spouses of public safety officials from all or a portion of tax.

Summary of provisions

Section One - amends section 466-h of the real property tax law, as added by chapter 305 of the laws of 2006 to state a town, village or county may adopt a local law or ordinance allowing an unmarried spouse of a paid or volunteer firefighter, ambulance worker or policeman to be exempt from a portion or all of the real property taxes imposed under this chapter provided.

Section One - states such deceased volunteer must be an enrolled member for at least twenty years and died in the line of duty. Such exemption shall apply only to the primary residence of the unmarried spouse.

Section Two - this act shall take effect immediately.

Justification

This legislation will allow a town, village or county to provide an unmarried spouse of a volunteer or paid police officer, firefighter or ambulance worker whose husband or wife died in the line of duty and served more than 20 years to provide a tax exemption if they so chose to.

This legislation gives a local municipality the option to pass a local law or ordinance if they so chose to honor and pay respect to the family of a fallen police officer, firefighter or ambulance worker who died in the line of duty.
