BILL NUMBER:S7262

Title of bill

An act in relation to requiring notification to certain federal and state agencies when certain persons with diplomatic immunity violate the law

Purpose or general idea of bill

To require notification to appropriate federal and state authorities when individuals with diplomatic immunity have violated or potentially have violated criminal laws in New York.

Summary of specific provisions

This act requires that in each incident where a person avoids arrest or detention based on their diplomatic immunity status, for the violation or potential violation of a crime that is punishable as a misdemeanor or felony, both federal and state authorities should be notified. This bill also requires the division of criminal justice services to make an annual report summarizing statistical information about these incidents.

Justification

Currently there are no formal notifications or recordkeeping requirements at the state or federal level of incidents where diplomatic immunity is invoked to escape arrest, detention or prosecution. This bill establishes a system that will help to provide federal and state officials with information about the use of diplomatic immunity in New York State, and thereby help to protect the public from diplomatic staff who repeatedly violate the law.
