BILL NUMBER:S7263

Title of bill

An act in relation to legalizing, validating, ratifying and confirming actions of the Scarsdale union free school district with respect to the establishment of a reserve fund in connection with its self funded health care plan

Purpose

The purpose of this legislation is to legalize and validate actions taken by the Scarsdale Union Free School District in relation to the creation and operation of a reserve fund created in connection with the districts self-funded health insurance plan.

Summary of provisions

This bill would legalize, validate, ratify and confirm the actions of the Scarsdale Union Free School District in creating a reserve fund in connection with the school districts self funded health care plan.

Justification

The Scarsdale Union Free School District has a self-funded health insurance plan and created a reserve fund in relation to that plan in order to address fluctuations in claims from year to year. This legislation will clarify in state law the authority to maintain an associated reserve fund as part of the program.

Interestingly, General municipal law currently authorizes municipalities to participate in Cooperative Health Insurance programs, and Article 47, section 4706 of Insurance law actually mandates that a reserve fund be created in relation to such an insurance plan.

The use of this self-funded health insurance plan has been determined by the school district to be the most cost effective way to provide health insurance to district employees.
