BILL NUMBER:S7298
Title of bill
An act to authorize the widow of Thomas L. Miller to file a retroactive application for retirement with the New York state teachers' retirement system
Purpose
To allow Jane A. Miller to file a retroactive retirement application with the New York state teachers' retirement system on behalf of her deceased husband.
Summary of provisions
Section 1: See purpose section above. Section 2: Effective date.
Justification
Thomas Miller was a member of the New York state teachers' retirement system, who retired on July 1, 2009, from his employment with the Newburgh enlarged city school district as a teacher. Before his death on September 20, 2009, Mr. Miller, due to his failing health and for reasons not ascribable to his own negligence, failed to file an application for retirement with the New York state teachers' retirement system on or before June 1, 2009. Due to this failure to submit proof of retirement to the NYSTRS, his surviving spouse, Jane Miller, may only receive Pre-Retirement Death Benefits. This legislation would correct this issue by. allowing Mrs. Miller to file retroactive retirement application with the NYSTRS.
