BILL NUMBER:S7311

Title of bill

An act to amend the insurance law, in relation to the definition of employer for group health insurance

Purpose

To expand participation in group accident and health insurance by municipal employers.

Summary of provisions

Section 1 of the bill amends Section 4235 (d) to expand the definition of "employer" to include public benefit corporations.

Section 2 of the bill establishes the effective date.

Existing law

Current law defines "employer" as including any municipal corporation, or the proper officers, as such, of any unincorporated municipality, or any department of such corporation or municipality determined by conditions pertaining to the employment. Furthermore, current law does not permit municipal employers or public benefit corporations with less than 50 employees to join a multi-employer trust without affecting the trust's status as experience rated.

Justification

Article 42 establishes multi-employer trusts to provide a mechanism for employers to band together to collectively purchase health insurance and prescription drug coverage at a reasonable rate, for their covered employees and retirees. Public Benefit Corporations and municipal corporations with less than 50 employees have expressed interest in joining multi-employer trusts. Since these employers are supported with public funds it seems prudent to allow them to join with other employers as a means of purchasing lower cost health insurance for their employees.
