BILL NUMBER:S7361
Title of bill
An act to amend the executive law, in relation to oversight of intelligence data centers
Purpose or general idea of bill
The purpose of this bill is to protect privacy and increase oversight of intelligence data centers also referred to as fusion centers in New York.
Summary of specific provisions
Section 1. Establishes the office commissioner for the Office of Data Protection and Privacy Oversight for New York State Fusion Centers and other Intelligence Data Centers as well as duties and qualifications. This section also defines appurtenant terms.
Section 2. Prohibits state and local law enforcement agencies among other entities from collecting certain information unless it relates directly to an investigation of criminal activities and there is a reasonable belief that the subject of the information is engaged in criminal conduct.
Section 3. Mandates the effective date of the act for one hundred and eighty days after enactment.
Justification
There are presently six intelligence/fusion centers in operation throughout the state. These centers are operated by either state or local law enforcement agencies. Currently there is limited oversight and accountability as it relates to the retention and dissemination of information at these facilities. This bill creates meaningful privacy and civil rights protections and oversight.
