BILL NUMBER:S7383

Title of bill

An act to amend the public health law, in relation to authorizing adult day care programs to provide certain services at the site of a voluntary residential health care facility rightsizing demonstration program

Purpose

To authorize adult day care programs to provide certain services in a more flexible manner in order to continue meeting the needs of the senior and the disabled within the community as the state transitions to a mandatory managed care environment.

Summary of provisions

Section one amends Public Health Law §2801-e to provide adult day health care programs with programmatic flexibility to meet the needs of seniors and the disabled in the community within the mandatory managed care environment. Under this section, approved adult day health care programs, upon notification to the Department of Health (DOH), may provide services to persons with health care needs, health care and social needs, or only social needs at the same time and location up to 130% of the program's approved capacity. These programs may provide an enrolled individual with a subset of adult day health care services pursuant to a service plan agreed upon by the program and the managed care organization. For programs approved prior to January 1, 2012, sponsorship may be transferred from a residential health care facility to a managed long term care plan upon notification to the DOH.

Section two provides that this act shall take effect 60 days after enactment, with the DOH authorized and directed to promulgate, amend and/or repeal, on an emergency basis, any rules and regulations necessary.

Justification

Adult day health care is a community-based long term care program that provides health care services in a congregate day setting and plays an important role in New York's long term care system. The current regulatory structure for adult day health care is designed for a fee-for-service system and limits the ability of adult day health care programs to cost effectively meet the needs of the chronically ill, disabled and frail adults within mandatory managed long term care, to which New York's Medicaid program is transitioning. This bill provides adult day health care programs with programmatic flexibility to continue meeting the needs of the senior and the disabled within the community.
