BILL NUMBER:S7529

Title of bill

An act to authorize Alexander Nicholas to take the competitive civil service examination and be placed on the eligible list for appointment as a full-time police officer for the village of Greenwood Lake, county of Orange

Purpose or general idea of bill

Allows Alexander Nicholas to take the competitive civil service examination for full-time police officer.

Summary of specific provisions

Section 1 - Notwithstanding the provisions of section 58 of the Civil Service law, or any other law to the contrary, Alexander Nicholas, who has been continuously employed by the village of Greenwood Lake as a part-time patrolman, shall be eligible to take the competitive civil service examination for the position of police officer and based on his score, placed on the eligible list for appointment as a full-time patrolman for the village of Greenwood Lake.

Section 2 - Alexander Nicholas shall otherwise be subject to the merit and fitness provisions of the civil service law applicable to full-time police officers.

Justification

Section 58 of the New York State Civil Service Law prohibits an individual over the age of 35 from taking the competitive civil service examination for the position of police officer. Alexander Nicholas is currently a part-time police officer for the Village of Greenwood Lake Police Department. Officer Nicholas is fully trained and is physically able to perform his job duties as a police officer. This legislation is necessary to allow Alexander Nicholas to take the competitive civil service examination for the position of police officer and to be placed on the eligible list for appointment as a full-time patrolman notwithstanding Section 58 of the Civil Service Law.
