BILL NUMBER:S7647
Title of bill
An act to authorize the town of Ellicottville, county of Cattaraugus to transfer funds from an unappropriated fund balance for the construction of a highway garage
Purpose or general idea of bill
This bill authorizes the town of Ellicottville, county of Cattaraugus to transfer funds from the fund balance in the highway fund to the general fund for the purpose of constructing a highway garage.
Summary of specific provisions
Section 1 authorizes the Town of Ellicottville, county of Cattaraugus, to transfer funds contained from an unappropriated fund balance in the town's highway fund to the general fund for the purpose of expending such funds for the construction of a highway garage. The transfer must be approved by resolution of the Town Board by majority vote and shall not exceed $500,000.00.
Section 2 says that this act shall take effect immediately.
Justification
The Town of Ellicottville has sold its current highway garage to a private business, and is desirous of constructing a new highway garage in a different location. The Town intends to use the proceeds from the sale of the current highway garage toward the construction of the new garage. State law requires that the sale proceeds, as well as the costs of constructing a new highway garage, be incurred by the General "A" Fund of the Town's budget. The Highway "B" Fund of the budget has an unappropriated fund balance of over $500,000.
The Town of Ellicottville is requesting permission under Section 40 of the Municipal Home Rule Law to transfer up to a maximum of $500,000 from the Highway "B" Fund unappropriated fund balance to the General "A" Fund for the purposes of constructing a highway garage. Because the Town has the funding available for the construction of the highway garage, they would prefer not having to issue a bond for such work.
This legislation was requested by the Town of Ellicottville.
