BILL NUMBER:S7680

Title of bill

An act to amend the public authorities law, in relation to maintaining a public health facility or for providing health care services

Purpose

To restrict public benefit corporations organized under article 10-C of the Public Authorities Law from creating or organizing subsidiary corporations without obtaining legislative approval.

Summary of provisions

Section 2827 -a of the Public Authorities Law is amended by repealing existing subdivision 7 and enacting a new subdivision 7 to restrict the ability of public benefit corporations organized under article 10-C of the Public Authorities Law from creating or organizing subsidiary corporations.

Justification

Public health facilities created under Article 10-C of the Public Authorities Law are intended to serve the health care needs of the general public. Recently, some of these facilities have created subsidiary corporations as a way to close facilities and programs that are desperately needed by residents of the communities served by the facility. This law will ensure that these public benefit corporations uphold their statutory intent of serving the general public and restrict the ability to create subsidiary corporations that would undermine such purposes.
