BILL NUMBER:S7801

Title of bill

An act to require certain uses of class B multiple dwelling to undergo a petition and public hearing process with the relevant community board

Purpose

The purpose of this bill is to require class B multiple dwellings as defined by subdivision 9 of section 4 of the multiple dwelling law with units leased or rented for a period of less than twelve hours and located on or within two-hundred-fifty feet of land zoned for residential use or a school shall require a petition to be filed and approved by the community board for the area where the housing is to be located.

Summary

Section 1. Amends the multiple dwelling law to require class B multiple dwellings as defined by subdivision 9 of section 4 of the multiple dwelling law with units leased or rented for a period of less than twelve hours and located on or within two-hundred-fifty feet of land zoned for residential use or a school shall require a petition to be filed and approved by the community board for the area where the housing is to be located. The community board shall have forty-five days after such petition has been filed to conduct a public hearing and render a decision within thirty days of such public hearing as to whether the multiple dwelling shall operate in that location. Section 2. Effective date.

Justification

Multiple dwellings that are operating within close proximity to residential communities that allow residents to rent or lease units for short periods of time may attract transient renters or leasees into these communities; potentially posing a threat to community cohesiveness and public safety.
