BILL NUMBER:S1463A

Title of bill

An act to amend the correction law, in relation to creating a felony possession of a firearm registration act

Purpose or general idea of bill

This bill would amend the corrections law by establishing a registry compiled of people that have been convicted of criminal possession of a firearm. The people on this registry would be removed once they have finished their sentence and any probation associated. The division shall operate a telephone number that members of the public may call free of charge and inquire whether a named individual required to register pursuant to this article is listed. The division shall decide whether a named person reasonably appears to be a person listed, based upon the information from the caller. Then provide the caller with pertinent information about the offender's location and other information.

Summary of specific provisions

Section 1. The correction law is amended by adding a new article 6-D the Felony Possession of a Firearm Registration Act.

168-bb. Definitions.

168-cc. Duties of the division; registration information.

168-dd. Offender; relocation; notification.

168-ee. Duties of the court.

168-ff. Discharge of offender from correctional facility; duties of official in charge.

168-gg. Duty to register and verify.

168-hh. Duration of registration and verification requirements.

168-ii. Registration and verification requirements.

168-jj. Notification of local law enforcement of change of address.

168-kk. Special telephone number.

168-11. Immunity from liability.

168-mm. Penalty.

168-nn. Unauthorized release of information.

168-oo. Separability.

Justification

This bill would allow members of the public to identify an individual who has recent prior convictions for felony possession of a firearm. Recently in the Bronx a young man was killed by a man who was recently convicted for felony possession of a firearm. If the public is more aware of an individual's past involvement with firearms they can be more wary of possibly dangerous people.
