BILL NUMBER:S2907

Title of bill

An act to amend chapter 430 of the laws of 2012 relating to a certain agreement for a payment in lieu of taxes, in relation to the effectiveness thereof

Summary of specific provisions

The bill clarifies that the provisions of L. 2012, c. 430 are only applicable for taxable years 2008 through 2012.

Justification

This legislation is needed to ensure that a leased prop- erty in the City of Poughkeepsie that was granted a qualifying empire zone enterprise is not unduly burdened with unexpected tax obligations as a result of "reach back" due to a change in policy by the New York State Department of Taxation and Finance.
