BILL NUMBER:S3933
Title of bill
An act to amend the town law and the public officers law, in relation to authorizing town justices in the town of Piercefield, in the county of St. Lawrence, to reside outside such town
Purpose
Provides that the town justice of the town of Piercefield, in the county of St. Lawrence, need not be a resident of such town.
Summary of provisions
Section 1 amends section 23 of the town law by adding a new subdivision 26 to allow the town justice of the town of Piercefield to not be an elector of such town.
Section 2 amends section 3 of the public officers law by adding a new subdivision to allow the town justice of the town of Piercefield to not be a resident of the town. Further the bill authorizes the person to be a resident of an adjoining county within the state of New York.
Section 3 contains the effective date.
Justification
This legislation will allow the town of Piercefield to select the most qualified person to be the town justice of the town of Piercefield, regardless of his or her residency status. Without this legislation the town of Piercefield would be limited to only being able to choose a town justice from within the town itself.
