BILL NUMBER:S3949
Title of bill
An act to amend the public officers law, in relation to residency requirements for public health director in the county of Herkimer
Purpose
To authorize Herkimer County to consider candidates for the position of public health director for Herkimer County from outside the county
Summary of provisions
The bill adds a new section to the public officers law granting Herkimer County the option of choosing a county public health director from candidates either within or outside of, and adjacent to, Herkimer County.
Existing law
Current state law requires that the county public health director be a resident of the county.
Justification
The measure is a home rule request from the Herkimer County Legislature that it be permitted to consider candidates for a county office from outside the county. The county is seeking to hire the most qualified candidate, and allowing the legislature to hire from adjoining counties broadens the opportunity to hire a superior candidate.
