BILL NUMBER:S4007

Title of bill

An act to amend the tax law, in relation to creating a tax credit for disabled persons; qualification

Purpose

This legislation would add an additional category of property owners and renters who would be eligible for circuit breaker tax relief.

Summary of provisions

This bill amends § 606 of the Tax Law, adding a new subsection (c-2) creating a real property tax credit for disabled persons modeled after the "Circuit Breaker" tax credit which now exists for senior citizens and certain individuals.

Justification

This act provides tax relief to those disabled persons who qualify for federal Social security benefits and are property owners or renters that pay a disproportionate amount of property tax in relation to their household income. The state recognizes the needs of the disabled and this would enable local governments to grant a tax credit. It would provide relief from locally imposed taxes to those disabled persons who are already burdened by their handicap and limited income.
