BILL NUMBER:S4056
Title of bill
An act to repeal section 271 of the highway law relating to limitations on amounts to be raised for the repair and improvement of highways by tax levy upon the vote of a town board
Purpose general idea of bill
Repeals the annual cap on the amount of tax dollars that municipalities can spend on equipment for the improvement of highways.
Summary of specific provisions
Section 1 repeals Section 271 of the highway law.
Section 2 sets an immediate effective date.
Justification
In 1936, the State enacted a law which set annual caps on the amount of money a town could raise in taxes to spend on repair and improvement projects of highways and the equipment needed for such repairs include plows, power rollers, concrete mixers and machines for grading and scraping roads. While the tax levy was a sufficient base to cover the costs of the equipment in the years following this law's enactment, the current law hampers the town's ability to provide necessary services.
Equipment needed for improvements inevitably costs substantially more than they did since this law's enactment and subsequent additions and restricting the money raised by the tax levy makes it difficult to update or purchase necessary equipment. This bill repeals this antiquated and now unnecessary law.
