BILL NUMBER:S4517

Title of bill

An act to prohibit the reduction of the disability retirements of responders, injured at the site of the World Trade Center terrorist attack, by any workers' compensation payments received by such first responders

Purpose

To prohibit the reduction of disability retirement benefits of responders to the 9/11 attack, by any amount of workers' compensation benefits received.

Summary of provisions

Section 1. Notwithstanding any provision of law to the contrary, the disability retirement benefits from any public retirement system of the state, as defined in section 501 of the retirement and social security law, of any retired member of such system who was a police officer, a firefighter or certified first responder, as defined in section 3001 of the public health law, and whose disability arose as the natural and proximate result of participation in the rescue effort conducted in response to the World Trade Center attack on September 11, 2001, shall not be reduced or set off by the amounts of any workers' compensation benefits paid or payable to such retiree. All workers' compensation benefits paid or payable to every such retiree, shall be payable in addition to any disability retirement for which the retiree is eligible. Section 2. This act shall take effect immediately.

Justification

This bill would be beneficial to 9/11 responder's because they are currently having their pensions off-set by their workers' compensation case dollar for dollar. Workers' compensation should be an addition to their income, not an offset. Almost 12 years after the tragic terrorist attacks, over 1,300 9/11 responders have passed away. Many are waiting for DOG/Federal government to compensate them. This bill would prohibit any reduction of their disability retirement and ensure they receive the benefits to which they are entitled.
