BILL NUMBER:S4584A
Title of bill
An act to allow Eric Brown to join the optional twenty year retirement plan, city of Johnstown, county of Fulton
Purpose or general idea of bill
This legislation authorizes the City of Johnstown to reopen the optional twenty-year retirement plan to firefighter Eric Brown, and allows Mr. Brown to elect to be covered under such optional plan as a Tier 5 member.
Summary of specific provisions
This bill authorizes the City of Johnstown to make participation in the optional twenty-year retirement plan, established pursuant to Section 384-d of the Retirement and Social Security Law as amended by Tier 5, available to Eric Brown, a firefighter employed by the City of Johnstown, who failed to make a timely application to participate in such optional retirement plan for reasons not ascribable to his own negligence.
Justification
The City of Johnstown had previously elected to offer the optional twenty-year retirement plan, established pursuant to Section 384-d of the Retirement and Social Security Law, to firefighters in its employ. Eric Brown, a firefighter employed by the City of Johnstown, did not bar himself from participation in such retirement plan as a result of his own negligence but failed to make a timely application to participate in the optional plan. This bill allows the City of Johnstown to reopen the Section 384-d plan to Eric Brown, so long as they request the same on or before December 31, 2013.
