BILL NUMBER:S4590
Title of bill
An act to amend the retirement and social security law, in relation to calculation of final average salary for certain members
Purpose or general idea of bill
This bill intends to provide additional pension benefits for certain members who had salary increases, performance advances, longevities or merit pay withheld for the fiscal years 2009-2010, 2010-2011, and 2011-2012.
Summary of specific provisions
Section one of the bill amends subdivision b of section 902 of the Retirement and Social Security Law to add a new paragraph 4 providing that employees designated as managerial or confidential who retire on a date falling between the effective date of this act and March 31, 2016 shall have their retirement benefit calculated as if all salary increases, performance advances, longevity payments, and merit payments were received in accordance with Chapter 10 of the Laws of 2008 and Chapter 491 of the Laws of 2011.
Section two of the bill provides that this act shall take effect immediately.
Justification
Chapter 10 of 2008 provided several classes of civil service members with salary increases, performance advances, longevities, and merit payments for the 2009-2010, 2010-2011, and 2011-2012 fiscal years. Chapter 491 of the Laws of 2011 provided additional increases for these civil service employees. While other civil service classes actually received these benefits, the Director of Budget withheld such benefits from members designated managerial or confidential. This bill seeks to level the playing field for managerial or confidential employees by requiring such members' benefits upon retirement to be calculated as if the aforementioned payments were received.
