BILL NUMBER:S4612

Title of bill

An act to amend the general business law, in relation to notifications required by tax preparers

Purpose

To give consumers greater access to the consumer bill of rights regarding tax preparers.

Summary of specific provisions

Section 1 amends the general business law to require that any tax preparer who offers online income tax preparation and filing services in New York include the consumer bill of rights for tax preparers on their website.

Section 1 also expands the requirements for the consumer bill of rights regarding tax preparers to require it to contain information regarding the tax free assistance program.

Section 2 is the effective date.

Justification

The Consumer bill of rights regarding tax preparers was created to assist individuals in knowing their rights when they pay someone to prepare their taxes. Through creation of low cost, and free tax preparation many individuals are receiving assistance in the completion of their tax forms. Many tax preparers are advertising themselves as having free filing, however they still charge a fee for preparation of the documents. While this is a legal practice, consumers should have a greater availability to be made aware of free preparation. Further with the ever increasing numbers of individuals who prepare their taxes online, this information should be required to be contained on tax preparers websites.
