BILL NUMBER:S4616

Title of bill

An act to repeal subdivision 10 of section 1000 of the retirement and social security law relating to requiring members of public retirement systems to pay a rate of six percent of annual compensation for military service credit

Purpose

This legislation repeals provisions requiring members of the public retirement systems, who join on or after April 1, 2012 to pay 6% of their salary for military service credit.

Summary of provisions

Section One - Repeals subdivision 10 of section 1000 of the retirement and social security law

Section Two - this act shall take effect immediately and shall be deemed to have been in full force and effect on and after April 1, 2012

Justification

In 2012, the legislature passed legislation that was labeled as pension reform. In this legislation, it required members of the public retirement system who joined on or after April 1, 2012 to pay 6% of their salary for military service credit.

The service men and women who risk their lives on a daily basis, spend years away from their family, and often pay the price of serious injury, deserve respect from the state of New York and its legislators. To lump this egregious proposal in with what is labeled as pension reform was a mistake, and is an insult to our brave service men and women.

This legislation will repeal the 3% increase that members of the public k retirement system who joined on or after April 1, 2012 will have to pay for their military service credit.
