BILL NUMBER:S4720
Title of bill
An act to amend the general municipal law, in relation to requiring taxing jurisdiction approval of payments in lieu of taxes
Purpose
This bill includes school districts in decisions about payments in lieu of taxes (PILOT).
Summary of provisions
Section 1 amends General Municipal Law § 859-a to require authorization to offer a payment in lieu of taxes(PILOT) agreement from school districts that would be affected by such PILOT.
Justification
Industrial Development Agencies are authorized to negotiate payments in lieu of taxes (PILOT) with private developers participating in IDA projects. Under current law, agency members who make decisions about PILOTS may but are not required to include schools. School districts, however, can be significantly affected by PILOT agreements. This bill, therefore proposes a process by which one or more school districts affected by a proposed PILOT agreement can represent the interests of the district, its schools and students.
