BILL NUMBER:S5067
Title of bill
An act to amend the environmental conservation law, in relation to extending the authority of the department of environmental conservation to manage squid
Purpose of Bill: The bill would extend the authority of the Department of Environmental Conservation (DEC) to manage squid.
Summary of provisions:
Section 1 of this bill would amend Environmental Conservation Law (ECL) § 13-0339-a(1)(h) to extend, until December 31, 2015, DEC's authority to fix by regulation measures for the management of squid (cephalopoda).
Section 2 of this bill provides that the bill would take effect immediately.
Existing law: ECL § 13-0339-a(1)(h) grants DEC regulatory authority, until December 31, 2013, for the management of squid.
Prior Legislative history: ECL § 13-1339-a was added by Chapter 196 of the Laws of 1999. Authority to manage squid was added by Chapter 589 of the Laws of 2002. This authority was last extended by Chapter 297 of the Laws of 2011.
Statement in support: ECL § 13-0105 establishes that the State's marine fisheries conservation and management policy shall be shall be consistent with any inter-jurisdictional management plans, interstate or state-federal. This bill would extend DEC's regulatory authority for squid for an additional four years, and ensure that DEC continues to be able to maintain compliance with any applicable federal management plan or Interstate Fishery Management Plan (FMP) adopted by the Atlantic States Marine Fisheries Commission. Authority to establish appropriate regulations consistent with the Federal FIVIP for squid is essential to provide uniform protection for this resource. Squid are managed by a Federal quota system which is applicable to federal waters and federal permit holders only. It is critical for DEC to maintain the authority to timely set and adjust trip limits and to close fisheries when quotas are reached, or to adopt other management regulations such as minimum mesh size to protect squid fisheries.
Budget implications: None.
Local Impact: None.
Effective Date: The bill would take effect immediately.
