BILL NUMBER:S5087
Title of bill
An act to authorize the commissioner of education to disregard a reduction in the apportionment of public money to the Clarkstown central school district
Purpose
Provides that the Clarkstown central school district shall be entitled to full aid notwithstanding the fact that they were in session for only 179 days.
Summary of provisions
Section 1 of the bill provides that, notwith- standing the fact that the Clarkstown central school district was only in session for one hundred seventy-nine days in the 2012-2013 school year, the Commissioner of Education is authorized to disregard the reduction of state aid required pursuant to section 3604 of the Educa- tion Law and shall pay the Clarkstown central school district it's apportionment as if it had been in session for the required one hundred eighty days. Section 2 provides the effective date.
Justification
The Clarkstown Central School District failed to meet the minimum of 180 session days due to devastating weather conditions caused by Super-Storm Sandy and an unexpected snowstorm on March 8, 2013. Under ordinary circumstances, Education Law requires that districts utilize scheduled vacation days to make-up any days of instruction to fulfill the 180-day requirement. However, Clarkstown was unable to reschedule days during available vacation days during "Spring Break" due to possi- ble infringement of religious practices surrounding the holidays of Passover and Easter. Large numbers of people from both the Jewish and Christian faiths reside in the district, and require those vacation days to observe religious customs and be with their families. Being away from school, and together with family, is an essential part of growing up and is not something that Clarkstown school district was comfortable inter- rupting by scheduling a make-up day. This legislation will authorize the Commissioner of Education to disregard a reduction in state aid due to the extraordinary and unique circumstances, which caused the school district to be in session only one day less than the required 180. Furthermore this legislation is essential to prevent the burden of lost foundation aid being placed onto the local taxpayers.
