BILL NUMBER:S5098A
Title of bill
An act to amend the mental hygiene law, in relation to increasing the number of visits with no prior notice that can be made to a facility per year
Purpose
To increase the number of unannounced inspections conducted at facilities operated and/or licensed by the Office of People with Developmental Disabilities (OPWDD) to a minimum of two per year.
Summary of provisions
Section 1 of the bill amends subdivision (a) of section 16.11 of the mental hygiene law to increase the number of unannounced inspections of facilities from a minimum of one to a minimum of two per year.
Section 2 is the effective date.
Existing law
Subdivision (a) of section 16.11 of the mental hygiene law states that at least one inspection of a facility be made without prior notice to the facility
Justification
This bill would maintain the same number of inspections of a facility at a minimum of two per year; however it would make them unannounced. Currently, only one unannounced visit per year of 0PWDD facilities is required by law. By having unannounced visits and inspections, facilities will maintain inspection standards throughout the year, providing the best care to the developmentally disabled.
