BILL NUMBER:S5140

Title of bill

An act to authorize the village of Hudson Falls, in the county of Washington to offer an optional twenty year retirement plan to police officer Brandon Kommer

Purpose

Authorizes the village of Hudson Falls to offer a 20 year retirement plan to police officer Brandon Kommer.

Summary of provisions

Section one of this bill authorizes the village of Hudson Falls, a participating employer in the New York state local police and fire retirement system, to make participation in the optional twenty year retirement plan as pursuant to section 384-d of the retirement and social security law available to police officer Brandon Kommer. The village of Hudson Falls may so elect to make such plan available by filing with the state comptroller, on or before December 31, 2014, a resolution of its board of trustees together with certification that such police officer did not bar himself from participation in such retirement plan as a result of his own negligence.

Section two includes all past costs associated with implementing this act shall be borne by the village of Hudson Falls.

Section three contains the effective date.

Justification

This bill has been requested by the village of Hudson Falls and would allow the village to offer the optional twenty year retirement plan, as established by section 384-d of the retirement and social security law, to police officer Brandon Kommer. Brandon Kommer is employed by the village of Hudson Falls as a police officer and for reasons not due to his own negligence, failed to make a timely application to participate in such retirement plan. Since the factors leading to the failure of a timely application being submitted cannot be credited to the individual and if the village of Hudson Falls chooses to file such with the state comptroller it is only fair to extend the optional twenty year retirement plan to this police officer who so bravely serves his community in a very dangerous profession.

Legislative history

Effective date

This act shall take effect immediately.
