BILL NUMBER:S5190
Title of bill
An act to amend the vehicle and traffic law, in relation to parking in areas designated for charging electric cars
Purpose
To create a penalty for a non electric plug-in vehicle which parks in an area designated for the purpose of charging electric vehicles.
Summary of specific provisions
Section one of this legislation amends the vehicle and traffic law by creating section 1205. Subsection 1 stipulates that any vehicle that stops, stands or parks in any area designated for the purpose of charging electric vehicles shall be in violation of this law, unless said vehicle is a plug-in electric vehicle that is being charged.
Subsection 2 stipulates that any person found in violation of subsection 1 shall be subject to a fine of not less than fifty dollars nor more than seventy-five dollars for the first offense and seventy-five to one hundred fifty dollars for the second offense occurring within a period of two years within the same municipality.
Section 2 states this act shall take effect immediately.
Justification
This legislation provides deterrence for the misuse of any area designated as a place for a plug-in electric vehicle to park and charge. Currently there is no penalty for any non-electric plug-in vehicle, or plug-in electric vehicle that is not charging, to be parked in one of these designated charging areas. This situation encourages the misuse of these areas by non plug-in electric vehicles and plug-in electric vehicles that do not require charging at that time. In order to set aside these designated charging areas for electric vehicles that require charging, it is important to provide a deterrence mechanism to prevent the misuse of these areas.
Prior legislative history
None.
Fiscal implications
Positive to local governments.
Effective date
This act shall take effect immediately.
